1.應具備可提供各該類科教學之適當空間、設備及經費

2.必須經核准才能設立

3.縣市控管班級數量，增班數不得超過全縣總班級數之百分之一點五

4.藝術才能班每班學生人數不得超過三十人

5.藝術才能班每班教師員額編制，高中及國中每班應置教師至少三人，國小每班應置教師至少二人
